Scaling the API thing is nonsense ... as there's no special skill involved. You just have to have the infrastructure to handle it and make sure that database operations don't lock tables.
As for the 55 hours per week, average ... yeah, that's what it's coming down to. So, they always try to spin the old "exempt" employee thing as a win-win, where you can work less than 40 and still get paid 40, but if you go over 40 you don't get paid OT ... EXCEPT they will NEVER pay you 40 if you don't put in 40.
I've tried to call them on it. "Hey, I only worked 30 hours this week, and since I'm salaried I shouldn't have to log PTO, since I regularly work 50 and never get paid for it." They refused. That's technically illegal, and there's a lawsuit waiting. As long as you work at all for 5 days, they have to pay you for a full week. So if one morning I get in and read my e-mail, that's a work day according to "exempt".
Then, they also introduced "Unlmiited PTO", except that it was just a scam, since they used it to "write off" a huge amount of accuмulated PTO from their books, and inflate their quarterly earning. Total scam. Then, they claim it's unlmited PTO, but then, they say you need approval from your manager to go over 4 weeks per year ... when I had already gone up to the 5 tier due to > 10 years of employment here. So my "unlimited" actually lost me a week per year of PTO. If you go over 6, you have to have the approval of the CEO. So their "unlmited PTO" is a scam". When my mother was passing away, I was going to test it, since I was helping my sister care for it, and take 6 months paid if necessary, and since I was caring for a dying relative, there's absolutely no way they could claim that was "abuse". Plus I had 5 weeks of rollover PTO that I had accuмulated over 10 years ... also wiped off the books. I would need 6 weeks of PTO (i.e. require CEO approval) for the next 5 years, just to break even with where I had been.
Then, during COVID, they actually cut our salaries by 10%, claiming that it was in order to avoid layoffs. That was a lie, since this company runs so lean that if they cut 10% staff, they would be at risk of going out of business, since they couldn't maintain operations. But, while they blamed COVID, you can actually see on the historical charts that their stock tanked by about 60% BEFORE COVID made any news, and after COVID it only fell maybe another 5%.
So, these people are all crooks.
