The court just issued a major decision in our lawsuit again New York Governor Andrew Cuomo and NYC Mayor Bill de Blasio and their jointly enforced COVID-19 “lockdown” that unfairly targeted religious gatherings for strict limitation, both indoors and outdoors.
 
I couldn’t be more excited to tell you that we’ve won a complete and total victory for religious freedom. The judge ruled that Cuomo and de Blasio could not allow mass gatherings of thousands for protests over the death of George Floyd, Black Lives Matter demonstrations and Juneteenth celebrations while banning outdoor religious gatherings of more than 10 or 25 people, depending on the region of New York State.
 
Cuomo and de Blasio had further singled out religious worship by restricting indoor religious gatherings to 25% of building capacity while every other business or entity is allowed to operate at 50% or 100% of indoor capacity, including restaurants in New York’s North Country region.
 
As the Court concluded: “Indeed, in the absence of an injunction, plaintiffs’ religious activities will be burdened and continue to be treated less favorably than comparable secular activities.  An injunction, on the other hand, does not undercut defendants’ interest in controlling the spread of COVID-19, provided that plaintiffs abide by social distancing guidance.”
 
As a result of our victory, outdoor religious gatherings will have no restrictions other than proper social distancing, and indoor religious gatherings will be allowed to operate at 50% capacity – just like comparable secular activities in New York – with proper social distancing.
 
While Cuomo and de Blasio threatened religious communities with fines and jail time, they actively encouraged, and the Mayor even participated in, protests by thousands with no social distancing. Cuomo and de Blasio openly proclaimed that religious freedom and religious speech were less important and less protected than the free speech of protestors. De Blasio praised demonstrations by thousands of people while ordering his police to kick a few children out of parks in the same neighborhood as the demonstrations.
 
The judge roundly rejected that unconstitutional double standard. To quote his opinion:
 
“Governor Cuomo and Mayor de Blasio could have just as easily discouraged protests, short of condemning their message, in the name of public health and exercised discretion to suspend enforcement for public safety reasons instead of encouraging what they knew was a flagrant disregard of the outdoor limits and social distancing rules.  They could have also been silent.  But by acting as they did, Governor Cuomo and Mayor de Blasio sent a clear message that mass protests are deserving of preferential treatment.”
 
This is a massive win for religious freedom! We were only able to win this great victory because of folks like you.
