X: Dear Mr. Hollingsworth-

You are very likely going to experience the consequences of your obstinacy and incomprehension.

Whoa! My “obstinacy and incomprehension,” huh? Listen, X, I don’t know you from Adam. You are a faceless, prolific contributor to the CI pages, that’s all I know about you. Yet you accuse another member of being obstinate, who will have to pay the consequences for his obstinacy. On whose authority do you say these things? BTW, sirrah, just what am I being obstinate about?

Quote
X: Do you seriously believe that Menzingen would just sit by while Mr. Kimmage gives away the store on CI??

That Menzingen would sue the family of ABL, menace Avrille, but leave CI unmolested (even though Menzingen monitors CI 24 hours/day)??

What I seriously believe is that you are attempting to intimidate Matthew and CI, and are working feverishly to throw people off the scent, for reasons that contribute even further to my “incomprehension.” These sermons have got to be even a bigger issue than we thought earlier.

X: I 100% expect Matthew to receive a letter from US District legal counsel within the next 30 days.

When that happens, let us talk again about who/what doesn't "smell right."
A letter for what reason? A letter warning against Fair Use or copyright violation? Thus far, to my knowledge anyway, no one has successfully downloaded these sermons. I know I haven’t, but would do so in an instant were I able.

You are assuming the role of a prophet here, X. Yes, let us see what happens in the next 30 days. Are you ready, Matthew? Are you ready for a letter from those sspx scoundrels in the US District? Wow, talk about incomprehensible!

Promise? Yes, give the keyboard a rest, by all means.

Are the sermons in French or English?
.
Are they the same sermons as in the books that got published by Editions Saint-Remi?
.
IIRC, +Fellay didn't sue the family, but the publisher, Editions Saint-Remi.  The family had given ESR permission to publish them, but the XSPX sued anyway.  I was told at the time:  "The sermons were transcribed on order of Mgr Lefebvre by Abbé Guépin who was then with the Society, and he kept them with the Archbishop's permission."

I assume that they are in French, but it would be nice to have some verification of that.

How is it possible that Bp. Fellay could sue the publisher, when the publisher presumably had permission from +ABL's family? I take it, then, that the family still have the sermons, and maybe Abbe Guepin does as well, since you assert that he kept them with +ABL's permission. Copies of the sermons are "out there" in various places, and not sure if the SSPX/Bp. Fellay has a right to full control of all of them. I don't see how they/he could.

If the SSPX wants to sue, let them.  No lawsuit will stop the circulation of the sermons, it will just make them more popular.

Wow... you unwittingly said it Megster!

The SSPX has always been wrong concerning the theological basis of Vatican II.

And you.... forgot to mention that Atila has proven that the VII docuмents are non Catholic .

But to +ABL's credit, his 238 Sermons, published in French were a basis for proving the Archbishop's conversion to uncompromised tradition.  In those sermons, he bashed the Conciliarist without any political reservations.

The judas apostle, Bp. Fellay, had to suppress that book, because it completely contradicted his shift to embrace newChurch.

There are still copies of it floating around, but Fr. Rostand claims they are illegal to own or read, because of SSPX copyrites.

That letter is very disturbing.

"How Does the DMCA Affect Webmasters?

Webmasters who are not engaged in copyright infringement are protected by the provisions of the Digital Millennium Copyright Act, especially if they host content for other internet users.

For example, one can find countless hours of user-submitted content on the video-hosting website YouTube. It would be impossible for YouTube to monitor all user-submitted items proactively, so the service would generally be protected from liability when users post infringing content.

In exchange for this protection, the service must promptly remove infringing content when notified.

Webmasters who choose not to remove infringing material after getting a notice may be subject to criminal or civil penalties. Generally, prosecution for copyright violations focuses on major perpetrators, often end users.

However, even when webmasters and hosts have not participated directly in wrongdoing, they might be found to contribute to copyright violations through negligence if they do not take proper steps to curb copyright violations.

That includes making contact information available to copyright holders and removing infringing material quickly."
