  • Washington (CNN) -- President Barack Obama and Republican challenger Mitt Romney are neck-and-neck in national polls, while Obama has an edge in crucial battleground states that will decide Tuesday's election.
The dynamic sets up a possible outcome that has happened rarely in American politics and could undermine the credibility of the victor -- Romney beats Obama in the overall vote, but the president gets reelected by winning the decisive Electoral College.
It would be the fifth time in history that the candidate who got the most overall support didn't win the election, and the first time that an incuмbent president prevailed without capturing the popular vote.

Analysts acknowledge that such an outcome could happen, especially when the race is so tight, but they called it unlikely.
State results generally follow the national trend, they say, so the chances were remote that Romney's victory margin in states he wins will be so much larger than Obama's in states the president wins that it would counter the Electoral College result.
"If the state polls are right, then Mr. Obama is not just the favorite in the Electoral College but probably also in the popular vote," Nate Silver wrote last week in the New York Times' FiveThirtyEight blog that analyzes polling data and trends.
Sean Trende, the senior elections analyst at RealClearPolitics.com, wrote last month that the chances of a popular/electoral vote split were about one in three if the candidates are within one percentage point of each other in the overall count.
Under the Electoral College system, each state is worth a certain number of electoral votes based on population. The winner of the popular vote in each state gets its electoral count, with 270 of the 538 available needed for victory.
The last split between the popular and electoral vote was 2000, when Democratic Vice President Al Gore outpolled Texas Gov. George W. Bush by more than 543,000 votes in the raw count but narrowly lost the electoral tally.
Campaign explorer: Ads, money and travel
In an outcome decided by a controversial Supreme Court ruling that gave Florida to Bush by 537 votes, the Republican challenger ended up with 271 electoral votes to Gore's 266, while Gore got 48.4% of the popular vote to 47.9% for Bush.
Prior to that, all previous occurrences were in the 19th Century, when the population was smaller and spread among fewer states. In 1888, Republican Benjamin hαɾɾιson defeated incuмbent Democratic President Grover Cleveland by 233-168 in the Electoral College even though Cleveland won 48.6% of the popular vote to 47.8% for hαɾɾιson.
Twelve years earlier, Republican Rutherford B. Hayes defeated Democrat Samuel Tilden by one electoral vote, 185-184, while Tilden won 50.9% of the popular vote to 47.9% for Hayes. The result was so contentious that it took a special electoral panel to decide that Hayes was the winner.
In 1824, John Quincy Adams lost both the popular and electoral vote to Andrew Jackson, who failed to get the minimum Electoral College support for victory. The House of Representatives decided the winner and chose Adams, the son of America's second president.
Any close election causes raw emotions and the uncertainty from popular/electoral vote splits can undermine the legitimacy of the winner, noted Wendy Schiller, a political science professor at Brown University. That would be especially true this time if Obama, the incuмbent, claims victory without getting more overall votes, she said.
"When you look at an incuмbent president that can't win the popular vote, you look at a guy that's very hobbled from the start," Schiller said. "For governing, it creates a much bigger problem than it does for the legitimacy of the election."
Margin of error: Why neither candidate has broken through
At the same time, she added, it would be hypocritical of Republicans to cry foul when they benefited from the same situation just 12 years ago, saying: "If you win that way, you have to be prepared to lose that way."
Another factor that could contribute to a popular/electoral vote split is devastation from Superstorm Sandy in states like New York and New Jersey, which were expected to provide strong support for Obama. While the president will still win both, his overall vote total could be lower if turnout is reduced in the aftermath of widespread power outages and structural damage from the storm.
Schiller, however, said the election results would clearly demonstrate such a scenario, providing an explanation for what happened that would soften challenges to the legitimacy of an Obama victory via the Electoral College.
"I don't see any legitimate claim by either side that the system isn't going to function well, even if you get this distortion," she said.
    Find your polling place
Electoral College voters, called Electors, will meet on December 17 in their respective states and vote for president and vice president on separate ballots.
In the case of a tie between Romney and Obama, the House of Representatives would meet in January to decide the president, with each state getting one vote. The Senate decides the vice president.
With the likelihood of a Republican-controlled House and a Democratic-led Senate, an Electoral College tie between Obama and Romney would make possible a split administration, with Romney as president and incuмbent Joe Biden as vice president.

  • Obama wouldn't be able to win without voter fraud.

  • So our votes won't even matter?

As far as I was concern.   With the acorn scandal obama should have been disqualified..

There has already been problems with absentee ballots..

Also, with Naacp already taking over polling stations in Houston and the voting nightmare in New jersey and east  coast makes it really easy for dirty deeds.

I think we are ready for Roman Catholic party to move towards the Social Kingship of Christ.
May God bless you and keep you

  • The voting machines are being tampered with. Because the powers to be want
an Obama reelection because he serves the globalists agenda. However,
Romney is no different, and may get us into an another war faster than
    Obama.
For the first time since I cast my first vote in 1968, I will not be voting.
No more lesser of two evils.

Romney leads among whites by 15 points, 56-41 percent – but they account for just 74 percent of likely voters, the same as in the 2008 exit poll and down from 90 percent in 1976. A quarter of likely voters are nonwhite, and they prefer Obama by a vast 76-20 percent, including by 96-3 percent among blacks and 61-31 percent among Hispanics. A similar equation led to Obama’s election in 2008, when he lost whites by 12 points but won the presidency nonetheless. Turnout among racial groups thus is critical to this year’s outcome.

A few days ago I would have agreed with you.  One thing's for sure, if Romney does win, there are going to be a lot of very upset and deeply stung Obama supporters.

  • I could see another "Rodney King Riots"-like event happening if Obama doesn't win a 2nd term.

Black people are so racist!  I don't care how it sounds; it's simply true. Just look at those numbers! Almost every black person alive in the U.S. is rallying for Obama, mostly because of his skin color.

Blacks are much more obsessed with race than any white man could ever be.

A black person tempted to vote for Romney (or anyone other than Obama) would feel like he's betraying "his people".

This is why only white male landowners should be allowed to vote. This country is toast.

You should need to A) be rational B) have "skin in the game" (own property) to be able to decide the fate of a country.

Women voted for Clinton because he was better looking -- in other words, they were looking at the candidates like potential sɛҳuąƖ partners. Blacks vote/voted for Obama because he's part black. Poor people and illegal immigrants across the nation vote for the Democrats because they tend to give out more "freebies".

See why I give up on America?

  • CNN's polls ridiculously oversample democrats as if they will turn out in '08 numbers. Thus, add about 3-4 points for Romney in every CNN poll and you'll get the truth. A lot of these polls are going to be completely embarrassed and lose credibility ala the Zogby poll (don't hear much from him lately do you?) once the results are in.

The blacks and the darker races will always vote racially, even a well respected black General like Colin Powell crossed party lines and openly threw his support for the black Democrat Obama in the last election. It's no suprise really that blacks will always choose race over ideology. But the scuмbag mass media will always blame whites as being "racist" for voting for a white candidate.

And also like you said, the minorities always want the free handout which will always come at the expense of whiteys wallet. whitey is always voting to protect what he's legally earned and the libs and their leftist cohorts are always out to rob him of it. this can not go on forever, something has to give sooner or later.

I predict an interior cινιℓ ωαr when it all breaks down eventually because one half of the country just cannot afford to support the other half indefintely, lines will be drawn among many social variables, but race will be the most obvious.

    Bad days ahead folks.

That's why I think that Romney will win, most of these polls are drastically oversampling Democrats so as to make the election appear closer than what it is in reality.

But RC1953, one doesn't have to vote for president.  You can skip the prez vote and still have a valid ballot while voting on the other issues.  Here in Michigan, every ballot proposal on the ballot is an attempt to make the proposals an amendment to the State's constitution, better believe I'll vote today, but not for the already chosen puppet.  Oh sorry, I meant president.
