  • I got this e-mail from an individual on a local message board. Dove Crossing is a subdivision I've driven past several times.

    Dear Friends and Neighbors;
    I am writing with a plea for help and give permission for crossposting. In March of this year, our HOA (Homeowner’s association) changed management companies and we never received another bill for our association dues. Our dues were current with the former management company Patton and Associates through the first quarter of this year.
     
    When I became aware that we hadn’t been billed in sometime, I called the new management company to ask if the billing cycle had been changed from quarterly to annual as I had not received any bills since the management change. They informed me that billing was still quarterly and would not explain why we weren’t being billed and referred me to their attorney Tom Newton. I immediately called the attorney’s office and left a message. Two days later a representative from that office called me back and told me that they didn’t have an assignment in mine or my husband’s name and referred me back to the management company Procomm. I again called Procomm and was told that they would investigate and call me back the same day. They did not.
     
    I called again the following week expressed my frustration at the lack of information and repeatedly expressed my desire to pay my bill. I was then told it was an internal error within their office and our account had mistakenly been sent to collection. I was told it would be resolved and someone would call me back. When I finally received a call back, I was referred to a second attorney, Cappuccio and Associates and again reps from ProComm refused to give me any information, refused to tell me how to pay my dues or give me any board of director’s contact information.
     
    I immediately called Cappuccio and Associates and was sent to voice mail where I left a message begging for information and expressing my frustration at being run around for a month in the simple attempt to pay my dues. No one returned my call.
     
    Then, on October 13, 2010 we were served notice that the BOD of Dove Crossing Homeowners Association was suing us for over $1,000 in legal fees for the collection of 6 months unpaid dues (amounting to $120) and threatening to foreclose on our home if we didn’t pay.
     
    Still believing this was all a terrible mix up and our account somehow got lost in the exchange of management companies we were able to find contact information for two board members and privately approached them. While both were initially receptive and admitted there was a mishandling of our account, they have since stopped returning my calls and their attorney is now demanding $1,800 to settle out of court.
     
    The BOD is fully aware that it would cost us more to fight the righteous battle than submit to their abusive practices and is taking advantage of it. So we are asking for your help and support to stop their abuse. Specifically, at this point, I ask that you write to the board of directors asking them to drop this suit and all associated legal fees and have written a sample letter below my signature. I remain hopeful that we can avoid going to court to resolve this, but we are willing to do so to keep others from having to suffer through this and stop the tyrannical actions of this board. We have enlisted the help of the National Homeowners Advocate Group and it’s president Harvella Jones has graciously agreed to intervene on our behalf. Additionally, Brian Mylar from KSAT trouble shooter in San Antonio is interested in doing a story if the board will not drop the suit and I have contacted other local media. This past month has been among the most stressful I’ve ever experienced and the greatest distress I feel is the betrayal and am having a difficult time coping.
     
    For those who don’t know us, we are community minded folks. We’ve been therapeutic foster parents for 6 years having parented nearly 20 foster children two of whom are still living with us, we volunteer in our community as a meals on wheels driver, little league coach, and at the theatre. My husband is a veteran, we work hard to leave a better place than we found, and are raising for biological children to be responsible, upstanding, contributing members of society. The bottom line is we care about our community and are deeply wounded by this action.
