Interesting link Caminus, in at least better explaining the genesis of the idea.  Here are the problems  a sticking problem however and this reality.

It's folly to think that someone can wave a fatwa, or any kind of religious docuмent to be exempted from a law unless a law already plans for such exceptions.  Matters of disagreement are usually resolved in the court system, so this is not a problem with what has come to be known as Obamacare, but rather with some Muslims and their observance of a Fatwa... ok, fine.

But even then, both articles suppose that one is obligated under Obamacare to buy health insurance... which is not true.  This requirement, which only start in 2014, is for most people to either buy insurance, or pay a tax.

Muslims who by strict observance will not buy the insurance out of their belief system, but there is nothing preventing them from paying the tax though.  More then that, they will be obligated, unless of course there is an amendment at some point, but this is not on the radar for the moment.

I've not read the actual law, but I do believe the requirement is not that you must buy insurance, but that you must have health care cost support. So, if groups such as the Amish already have in place a way to pay for high medical bills (such as sharing the costs among their community), they would not have to buy additional insurance.

In other words, a Muslim can do without health insurance as a matter of principle, but still face a tax. which will not go against his own protection.
