    h0Ɩ0cαųst exploitation
    Some weeks ago I reviewed "The h0Ɩ0cαųst in American Life," a scholarly study by a University of Chicago professor, Peter Novick. Among other things, Prof. Novick declared how Jєωιѕн spokespersons have consistently manipulated and exploited h0Ɩ0cαųst perception to suit the Jєωιѕн agenda of the moment.

    During World War II the Jєωιѕн leadership was anxious to convince Americans that Hitler wasn't just persecuting Jєωs. Christians also were vulnerable, especially Polish Catholics. At the end of the war Jєωιѕн leaders thanked Pope Pius XII for his efforts to rescue Jєωs.

    Today the political winds blow in a different direction. The Anti-Defamation League (ADL) has all but said that the h0Ɩ0cαųst was Catholic-inspired. Pope Pius XII ("Hitler's Pope") is condemned for his "silence" during the war. Apologies to the Jєωs by the Pope John Paul II are not enough because, in the words of World Jєωιѕн Congress (WJC) President Edgar Bronfman, the pope failed to apologize for all of Catholicism's sins against the Jєωs, "especially the h0Ɩ0cαųst."

    The h0Ɩ0cαųst was all but ignored by Jєωs (some were even ashamed to discuss it) until the 1967 Six-Day War in Israel. Today the h0Ɩ0cαųst is the shield that deflects criticism of Israeli policy; even to question Israel's behavior is to risk being branded an "αnтι-ѕємιтє."

    Now comes a book titled "The h0Ɩ0cαųst Industry: Reflections on the Exploitation of Jєωιѕн Suffering" by Norman G. Finkelstein, the son of h0Ɩ0cαųst survivors, which picks up where Dr. Novick left off. A professor at Hunter College in New York, Dr. Finkelstein believes the Jєωιѕн elite is exploiting the h0Ɩ0cαųst for personal, political and economic reasons which have little to do with their professed goal of enhancing "h0Ɩ0cαųst awareness."

    Respected Israeli writer Boas Evron describes "h0Ɩ0cαųst awareness" as "an official, propagandistic indoctrination, a churning of slogans and a false view of the world, the real aim of which is not an understanding of the past, but a manipulation of the present."

    According to Dr. Finkelstein, h0Ɩ0cαųst revisionism has made it possible for "one of the world's most formidable military powers, with a horrendous human rights record," to "cast itself as a 'victim state,' and the most successful ethnic group in the United States has likewise acquired victim status.

    Considerable dividends accrue from this specious victimhood - in particular, immunity to criticism, however justified."

    Today, Prof. Finkelstein argues, more Americans know about the h0Ɩ0cαųst than about Pearl Harbor. "All 50 states sponsor commemorations, often in state legislatures. The Association of h0Ɩ0cαųst Organizations lists over 100 h0Ɩ0cαųst institutions in the United States. Seven major h0Ɩ0cαųst museums dot the American landscape." The h0Ɩ0cαųst has become such a unique event that to compare it to genocides against other groups is viewed by the h0Ɩ0cαųst industry as a form of h0Ɩ0cαųst denial.

    Prof. Finkelstein exposes those Jєωιѕн leaders who use the h0Ɩ0cαųst to blackmail American politicians into unconditional support for Israel. Lawmakers who have adopted a balanced approach to the Arab-Israeli conflict can suddenly find their careers destroyed. Jєωs in Illinois have been especially effective in this regard, helping to defeat Rep. Paul Finley and Sen. Charles Percy, two Republicans who mistakenly counseled a more even-handed U.S. foreign policy towards the Middle East.

    "Two central dogmas underpin the h0Ɩ0cαųst framework," writes Prof. Finkelstein: "1) The h0Ɩ0cαųst marks a categorically unique historical event; 2) The h0Ɩ0cαųst marks the climax of an irrational, eternal Gentile hatred of Jєωs." The "most practiced purveyor" of the uniqueness of the h0Ɩ0cαųst, according to Prof. Finkelstein, is Elie Weisel (who once said "all of Ukraine is Babi [Babyn] Yar"), who has declared on various occasions that the h0Ɩ0cαųst is "never to be comprehend or transmitted" because it "lies outside, if not beyond, all history."

    The unique evil of the h0Ɩ0cαųst, according to Jacob Neusner, not only sets Jєωs apart from others, but also gives Jєω a "claim upon those other."

    Much of the literature on Hitler's Final Solution "is worthless as scholarship," writes Dr. Finkelstein.
    "Indeed, the fold of h0Ɩ0cαųst studies is replete with nonsense, if not sheer fraud."

    The first major h0Ɩ0cαųst hoax was "The Painted Bird," purported to be an autobiographical account by Polish émigré Jerzy Kosinski who "recalled" the sadistic torture of Jєωs by Polish peasants. Almost all of it was a lie. In reality, Polish peasants harbored Mr. Kosinski and his family from the nαzιs at great risk to their own safety.

    Another hoax was Binjamin Wilkomirski's book "Fragments," which the author represented as "recovered memory" of the sadism of German guards. Hailed as a classic of h0Ɩ0cαųst literature, it was exposed by the renowned h0Ɩ0cαųst historian Raul Hilberg. "Half-fruitcake, half-mountebank," writes Dr. Finkelstein, "Wilkomirski, it turns out, spent the entire war in Switzerland. He is not even Jєωιѕн."

    Following current academic trends, Yad Vashem Director Israel Gutman, a former inmate of Auschwitz, argued that "it is not important if 'Fragments' is a fraud. Wilkomirski has written a story which he has experienced deeply ... his pain is authentic." A similar "authenticity" argument was made for Nobel Peace Prize laureate Rigoberta Menchu, when it was discovered that her heart-wrenching autobiography of racist oppression in Guatemala was pure fabrication.

    Dr. Finkelstein reserves his most explosive rhetoric for the "outright extortion racket" that demands billions of compensatory dollars from Germany and Swiss banks because little of the money goes to actual h0Ɩ0cαųst survivors. The cash left after the lawyers take their share is earmarked for various pet projects of Jєωιѕн leaders, such as h0Ɩ0cαųst museums, h0Ɩ0cαųst publications and university chairs of h0Ɩ0cαųst studies.

    Big money drives the h0Ɩ0cαųst industry. Former Secretary of State Lawrence Eagleburger earns $300,000 per year as chairman of a h0Ɩ0cαųst claims organization. Rabbi Marvin Hier, dean of the Simon Weisenthal Center, has his wife and son on the center payroll; their combined family income five years ago was $520,000. Simon Wiesenthal himself commands $25,000 per appearance plus expenses.

    WJC President Bronfman claims that his organization has amassed "roughly $7 billion" in compensation monies.

    To survive, the h0Ɩ0cαųst industry is always searching for its next mark. Ukraine's turn is just around the corner.

    For a handful of shattered people, little will do

    The State of Israel was built on four foundations: the dream of the Zionist visionaries, the sweat of the pioneers, the courage of the fighters in the War of Independence and the pangs of guilt over the h0Ɩ0cαųst felt by the world, which voted in favor of its establishment in the United Nations in 1947.

     However there was also another foundation that the victims provided: reparations Germany paid for murdering six million European Jєωs. The sum of $750 million in the 1950s would today be the equivalent of several billion dollars; this sum financed a very sizable portion of the young state's economic infrastructure investments.

    Among those who contributed to its establishment, Israel behaved most shamefully toward h0Ɩ0cαųst survivors, the same handful of shattered people who chose to try to rebuild their lives in the Jєωιѕн state. It is perhaps possible to justify the fact that young people who had just stepped off the boat were sent directly to the front lines; it is possible, perhaps somewhat less justifiably, to argue that the Yishuv (pre-state leadership) was unable in the first few years to provide immigrants with more than a blanket, mattress, Jєωιѕн Agency standard issue bed and five liras.

    However there is no justification for the fact that Israel, after nearly 60 years of existence, has refused to provide survivors with the few hundred shekels they need for medication and the tax on television, which in the last years of their lives is just about their only means of entertainment and connection with the world.

    Forgetting the living
    At the beginning of the month, the Finance Ministry announced it opposed a bill to grant benefits totaling NIS 65 million to survivors. It would be willing to transfer only NIS 7 million to them. Further discussion of the bill, which for the first time defines who is a survivor, has been put on hold as a result. "Israel is always dealing with the dead, but has forgotten about the living," Ze'ev Feiner, a spokesman for the h0Ɩ0cαųsts Survivors Welfare Fund, said earlier.

    And indeed, who ever thought in the early 1950s that the state's greed for the property of landowners who died in the h0Ɩ0cαųst, for Waqf and church properties and for the homes of Ikrit and Biram would haunt the elderly h0Ɩ0cαųst survivors in the early 21st century? How has it happened that it is better today to be a h0Ɩ0cαųst survivor in the United States or France, not to mention Germany, than to be one in Israel?
    When considering the economic contribution to Israel, it is not just a matter of the reparations that Dr. Nahum Goldman and David Ben-Gurion obtained from Konrad Adenauer - tens of millions of dollars flowed into and through the Finance Ministry's coffers in Jerusalem. According to German data, Germany has so far paid over $60 billion to victims of the nαzι regime, some 85 percent of it to Jєωs.

    Each year it continues to pay around one billion dollars or so. However there are no precise figures on the sums arriving, directly or indirectly to Israel, where around half of the survivors live. According to a cautious estimate of the total sum, Germany transfers around $450 million annually to Israel. Most of the money goes to those receiving compensation, pensions and the like, but some of it is transferred via public institutions and transmitted as payments and services to victims. The same NIS 65 million that the Finance Ministry was asked to add, which it claims is an expense it cannot handle, is less than 4 percent of the annual sum the state receives from payments from abroad.
    As for the precise figures, there is a registry: Dovi Arbel, the executive director of the h0Ɩ0cαųst Survivors Welfare Fund, estimates that of the 200,000 or so h0Ɩ0cαųst survivors living in Israel, 20-30 percent are need of financial assistance, mainly for medical expenses. Other estimates refer to 20,000 h0Ɩ0cαųst survivors living below the poverty line. Others, sometimes almost exactly the same sources at different times, refer to 280,000 h0Ɩ0cαųst survivors, of whom some 80,000 live below the poverty line.

    Image versus expense
    The State of Israel, coincidentally or not, never legally defined who constituted "a h0Ɩ0cαųst survivor." Is it someone who emerged alive from the German cσncєnтrαтισn cαмρs? Someone who survived the forced labor camps and ghettos in countries either allied with, or occupied by, nαzι Germany? The Jєωs of North Africa and the Balkans who were under the rule of Fascist Italy?

    What is the status of Jєωs who managed to hide or join the partisans in the forests? The conflicting figures are the result, among other things, of various parties with vested interests. On the one hand, some favor increasing the numbers to increase the dimension of the despair; on the other hand, others favor limiting the numbers to reduce the "fear" of expenditures. Moreover, there is an effort to estimate how many survivors will be alive in 2010, for example, 65 years after the end of the war.

    The official "low" assessment refers to 167,000; the "high" estimate refers to 225,000. Some argue that with the aging of the survivors, health and welfare spending on them has increased (and therefore larger budgets are needed) and others respond that increasing numbers of survivors are dying each year (and therefore less money is needed for them).

    However, assistance for the needy among them is not the only area in which Israel is treating h0Ɩ0cαųst survivors disgracefully.

    The mistreatment started with the 273 Tehran Children, who were forced to appeal to the courts because they did not receive the few thousand dollars the Finance Ministry allotted them from the German reparations.

    The mistreatment continued with the millions of dollars the banks did not return to heirs of h0Ɩ0cαųst victims - victims who before the war deposited some of their money in financial institutions in Palestine.

    Bank Leumi recently announced it had set aside NIS 9.5 million for "adjusting" transfers that were too low, which it had at the time forwarded to the Custodian General. Tens of millions of shekels or dollars, depending on who you ask, is the value of the real estate purchased before the war by Jєωs who were killed in the h0Ɩ0cαųst - money which to this day has not been handed over to their legal heirs.

    Given the experience with Swiss banks and other countries where property of victims or Jєωιѕн institutions remains, it is not hard to imagine the kind of scandal that would erupt if another country were to act in the same manner and engage in property theft (or foot-dragging before returning it) as Israel has.

    This is the same Israel, which provides a car allowance to clerks who do not have driver's licenses, pays hundreds of thousands of shekels for "appropriate" dress for the wife of the prime minister and allocates millions in field grants to thousands of officers who since their basic training haven't stepped foot outside their offices that are far from the front lines.

    The calculation is simple: The survivors are older and do not have the strength to protest. The Jєωιѕн organizations hold, without justification, that it is more important not to damage Israel's good reputation in the world by airing the outcries of survivors, than it is to ensure a little improvement in their living conditions in their final years. Some 10 percent of survivors die each year and the pace is increasing. They will not be troubling us for much longer.

  • JUST HOW LOW A LAWYER CAN GO

     ABOUT 158,000 h0Ɩ0cαųst survivors have received a meager $1,450 each from the $1.25 billion settlement of a class action brought in their names against Swiss banks. Now Burt Neuborne, a court-appointed lawyer who had claimed for years to be representing the survivors pro bono, wants to be paid more than $4.75 million for his services.

    As the son of two survivors of Auschwitz and Bergen-Belsen, I am outraged. As a lawyer, I am appalled.
    By Neuborne's own written account, U.S. District Judge Edward R. Korman asked him in early 1997 to "serve in a pro bono capacity as cocounsel for the plaintiffs" in the Swiss Bank litigation.
    Two years later, the court appointed him as lead settlement counsel - and Neuborne allowed everyone concerned to believe he was still serving free of charge. Indeed, Judge Korman himself wrote in a July 2000 opinion, "Numerous lawyers, including plaintiffs' lead settlement counsel [again, that's Neuborne] have waived all attorneys' fees."

    If Neuborne was no longer acting pro bono, but instead intended to charge a fee for his services, he had an ethical and professional responsibility as a member of the bar to promptly advise both the court and his clients accordingly. He did nothing of the sort.
    Instead, he stated categorically in The Nation in October 2000 that "Every penny in the $1.25 billion Swiss bank case will go to h0Ɩ0cαųst victims," and ridiculed as "absurd" another lawyer's $4 million fee request. And, as recently as September 2005, Neuborne boasted to a federal judge in Miami that "I am the lead settlement lawyer in the Swiss case in which I served without fee now for almost seven years."
    It was therefore a tremendous shock when, last December, he submitted a multimillion-dollar fee application to the court.

     Was this a change of heart, or had he always intended to enrich himself at the expense of h0Ɩ0cαųst survivors?
    Note that Neuborne is no ordinary ambulance-chaser. A former legal director of the American Civil Liberties Union, he receives a substantial salary as a tenured professor at New York University Law School and legal director of NYU's Brennan Center for Justice.

    Yet he now wants to be paid at least $700 an hour on top of that for 6,878.5 hours he claims to have spent on the Swiss Bank case. Well, at least $700 an hour - he asked the court to consider paying him "a multiplier for excellence and augmentation of the settlement fund."
    That's right, he says $4.75 million is the minimum he should be awarded.
    No one should be expected to work for free. At the same time, it is grotesque when a lawyer tries to profiteer shamelessly from efforts to provide a modicuм of justice to the victims of the greatest crime against humanity in history. (For that matter, Neuborne has already pocketed $4.4 million from a settlement of h0Ɩ0cαųst-related claims against German corporations.)

    Every dollar awarded to Neuborne by the court is a dollar less available to provide health care to elderly survivors who worry about the high cost of keeping their homes warm this winter and whether they'll be able to pay for both medicine and food. The more than $4.75 million Neuborne demands could be far better spent to improve the quality of life of the men and women Neuborne purports to represent and enable them to live out their remaining years in dignity.

    There comes a point when even greed becomes unseemly. U.S. Magistrate Judge James Orenstein, who is reviewing Neuborne's fee application, should reject it out of hand and send the good professor back to NYU to teach - or at least to take a course in legal ethics.
    It is bad enough that most h0Ɩ0cαųst survivors have received only pitifully inadequate compensation for their suffering. They shouldn't also have to endure the insult of watching a lawyer whom they did not choose walk away with a windfall of millions of dollars at their expense. Menachem Z.     Pensioners: 'Boycott h0Ɩ0cαųst Day'By RUTH EGLASH

    Pensioners' rights group Ken Lazaken called Thursday for a boycott of official h0Ɩ0cαųst Remembrance Day ceremonies to protest the government's failure to sufficiently help the more than 70,000 h0Ɩ0cαųst survivors who live in poverty in Israel.

    "People should not participate in ceremonies to remember the dead, when really we should be remembering and helping those who are still living," Nathan Lavon, director of Ken Lazaken, said in an interview with The Jerusalem Post..

    He said 35 percent of Israel's estimated 250,000 h0Ɩ0cαųst survivors live below the poverty line, according to a study conducted by the JDC-Brookdale Institute. Many of them have to choose on a daily basis between buying food and paying for other basic needs, he said.

    "There needs to be a comprehensive law to ensure that h0Ɩ0cαųst survivors do not have to chose between food or medicine, to make sure they will be cared for until the end of their days," Levon said, adding that while he usually attends one of the official events, this year he plans to participate in an alternative ceremony - scheduled to take place on Monday at noon opposite the Knesset - to highlight survivors' needs.

    Levon said he was shocked earlier this week during a meeting of the Knesset lobby for h0Ɩ0cαųst survivors, which heard about the problems they encounter when asking the Finance Ministry to approve medical assistance. Several survivors described how the ministry panel responsible for allocating additional aid had demanded they prove their medical conditions or disabilities stemmed directly from nαzι persecution.

    "How can they possibly prove that these ailments came from the h0Ɩ0cαųst?" Levon fumed. "And why should h0Ɩ0cαųst survivors have to make a special request for glasses or dentures anyway? They should automatically get a discount for medicine."

    He also expressed anger over the government's stalling of funding for a law sponsored by the late MK Yuri Stern (Israel Beiteinu), which passed in January and is supposed to provide survivors with additional rent assistance and up to a 75% discount on medicine as soon as July.

    In response, Pensioners Affairs Minister Rafi Eitan told the Post that his office had made progress in improving the situation. He highlighted increases in budget for the Fund for the Welfare of h0Ɩ0cαųst Survivors in Israel, more hours of home help for survivors and a potential enlargement of the monthly stipend, which currently stands at NIS 1,000- 1,200 per month.

    "People think I can perform magic, that I am like Uri Geller and can bend spoons with my little finger, but I don't do magic, I do what I can do," said Eitan. "We are a new political party and are still finding ourselves."

    In response to Levon's demand for a comprehensive bill to help survivors as opposed to periodical legislative changes and increases in aid, Eitan said: "A law without financial backing helps no one, but increasing funding without a law does help people. Nathan Levon has been working on this for the last 10 years but he has not managed to get a law or money."
