You're right that I can't "declare" anyone to not be a Catholic more than I can't "declare" that the see is vacant. But I can have an informed opinion, based upon their external profession, that they are not Catholic.

It doesn't require a formal declaration to know that Joe Biden is no Catholic, much less a "devout" Catholic ... except if you ask Siscoe or Salza, who say Biden is a Catholic but sedevacantists are not.
