Because he's not making a judgment one way or the other.  This comment lets him go along to get along.  Cardinal Burke was someone I thought could possibly do the right thing.  This lukewarm response leaves much to be desired.

Oh, you wanted him to judge on the part where he says the Old Covenant is still valid for the Jews?

I thought it was a good start for him at least to recognize the "apostolic constitution" is not a doctrinal or dogmatic docuмent and that it's confusing.

Oremus that as "Supreme Justice" he may judge well and manfully.
