So the original question is unanswered.  My view is that ONLY the Church officials can determine pertinacity because only they have the authority to interview/challenge a pope on his unorthodoxy.  This is consistent with St Bellarmine and John of St Thomas (and maybe others).

Right, but Bergoglio is the least of my worries.  Paul VI is the big concern, since he's the one that brought us Vatican II and the New Mass.

Even with Bergoglio, the remarks could be viewed as flippant and irreverent, and if pressed by the Church on a matter, it's hard to say if he would recant.

So did John Paul II.  Yet whether or not he's a heretic is a separate matter entirely.
