    40. It is a probable opinion which states that a kiss is only venial when performed for the sake of the carnal and sensible delight which arises from the kiss, if danger of further consent and pollution is excluded.

    Why is it explicitly stated that the individual in question is unmarried in the 25th condemned paragraph, but in the 40th paragraph a general statement is made without defining whether the individuals in question are married or not? 

    Should one conclude that the 40th paragraph is also true in the case of spouses?

    "danger of further consent" seems to imply that it is speaking of the unmarried as it ok to consent to relations with your spouse.

    Because it is necessary to distinguish the gravity of sins. Adultery is graver than fornication.
